The Home Secretary may have acted unlawfully in refusing to intervene in the extradition of British computer hacker Gary McKinnon to the US, a High Court judge has said. The comments came as Mr McKinnon was granted leave for a judicial review over whether his human rights would be infringed were he to be deported. In papers handed down on Wednesday Mr Justice Mitting said the case raised "stark and simple issues." He said that medical evidence that Mr McKinnon would be at high risk of suicide "was yet unchallenged and unqualified." He added that the evidence, including a report by consultant psychiatrist Professor Jeremy Turk, may require the Home Secretary to "refuse to surrender [Mr McKinnon] to the government of the USA," adding "It is arguable that the decision [by the Home Secretary to allow the extradition] was unlawful." Previously the High Court had ruled that extradition would not violate Mr McKinnon's rights.
